Useful Forms and More Detailed Memos

This page contains links to various forms and memos. You can access these documents in various ways, but all of them require that you first download and install the free Adobe Acrobat reader software, which you can download from the Adobe web site using the link below).

To view the memos and forms:

  1. View in your Browser Online. Click on the link using Netscape or Internet Explorer and view the document in your web browser or in a separate Adobe Acrobat viewer, depending on how your web browser integrates Acrobat.

  2. Save the file and View Offline. Using the right mouse button, click on the link to the form or memo and then click "save as" and save the file in a directory of your own choice. Then load the Adobe Acrobat reader software and open the file.

  3. Download via Anonymous FTP and View Offline. Load your FTP software (such as WSFTP-LE, which is available from tucows.com, CWSApps, and other software sites) and log into rushforth.org and go to the pub/memos or pub/forms directory (depending on whether you want memos or forms). Transfer the forms and/or memos you want to your hard drive, which you can open using the Acrobat reader software.

The forms are provided to get information for the preparation of estate planning documents. Please feel free to use these forms, regardless of which attorney or firm does your estate planning documents. (If you click on a link to a web site that is not part of rushforth.org, it will open in another window on your web browser.)


Forms

In alphabetical order

  1. Affidavit of Entitlement - Form used to claim a deceased person's personal property if Nevada probate estate does not include interest in real estate and is less than $20,000.

  2. Estate planning asset checklist - Asset inventory checklist outlining information needed with respect to assets for estate planning, especially if a living trust is to own assets.

  3. Estate planning questionnaire - Basic family and fiduciary information for your initial interview with your estate planning attorney.

  4. Durable power of attorney for health care - Adapted from Nevada's statutory durable power of attorney for health care and Nevada's directive to physicians ("living will"), the form also includes organ donor instructions, as well as funeral and burial directives.

  5. Incorporation questionnaire - Basic information for your initial interview with your estate planning attorney.

  6. Supplemental Trust Schedule - "Deed and Assignment", which is used to supplement the schedule of trust assets and to document additions and deletions of trust assets.

  7. Nevada Probate Procedure Checklist - "Probate Procedure Checklist". This was developed in cooperation with Don Ashworth, Probate Commissione for Clark County, Nevada.


Memos

The memos are intended to be educational, but they are not intended to provide legal advice for any particular person or situation. Information contained in these memos is NOT an acceptable substitute for personal legal advice from an attorney who is (1) licensed in the state where you live; (2) experienced in the appropriate area of law; and (3) familiar with the details of your situation.

  11. Tax Planning for Couples - Estate tax planning in revocable trusts for couples. Discussion of estate tax savings through the use of marital trusts and credit-shelter trusts.

  12. Using A Charitable Trust and An Irrevocable Life Insurance Trust - Using a charitable trust to provide lifetime income, and using an irrevocable life insurance trust to preserve the estate for the family.
